Wittgenstein is associated with ’the linguistic turn’, and for the last 80 years his thoughts have been discussed and used in a variety of contexts, also in legal theory. H.L.A. Hart was the first legal thinker to use Wittgenstein in the 1960s, and several influential thinkers as Ronald Dworkin and Joseph Raz have followed him since. Especially the later Wittgenstein’s stress on the importance of language, context and practice make him fruitful in understanding legal language use and legal practices.
The seminar will introduce Wittgenstein’s philosophy and methods, the history of his ideas in jurisprudence and present cutting edge discussions of Wittgenstein in legal thinking.
